The Chairman will read the following announcement:

 

“Welcome to this meeting of the Planning and Regulatory Committee which is being filmed for live or subsequent broadcast.  Attendance at the meeting means you consent to being filmed and any images and sound recordings being used for public broadcasting or for training purposes.

Councillor Nicholson declared a non-pecuniary interest in application number 07/24/0584/F as a ward Member for Wormley and Turnford.

 

Councillor Chorley declared a non-pecuniary interest in application number 07/18/0021/O as a Governor of St Mary’s School.

 

Councillor Connolly declared a non-pecuniary interest in application number 07/22/0805/RM as he lives within close proximity to the Rosedale Sports Club.

 

All the Planning and Regulatory Committee Members declared an interest in application number 07/24/0370/F as the applicant was known to them.

(a)  a condition seeking details of the precise design, materials and location of the new fence to be installed around the sports pitches;

 

(b)  a condition requiring five additional trees to be planted as part of the development to upgrade the sports facilities and provide space for the strategic north-south path to serve the new primary school; such trees to be the same species of that replaced;

 

(c)  a condition requiring the provision of dog waste bins within the application site; and

 

(d)  the conditions set out at the end of the original report.

Since the publication of the agenda three further objections were received. Officers noted that these objections raised points that were already covered in the report and that the conditions addressed these concerns.

 

RESOLVED that the application be deferred for the applicant to consider the Committee’s observations regarding the mix of housing, the viability of the s.106 agreement, potential overdevelopment, carparking provision, liaison with the Police regarding secure by design, height and bulk of the potential development, privacy for neighbouring residents, construction management, and groundwater issues.

Since the publication of the agenda, it was noted that Hertfordshire County Council’s Growth and Infrastructure Team had requested additional sums to the Heads of Terms of the proposed s.106 agreement. The officers indicated that to accede to this request would affect the viability of the proposed development.

 

RESOLVED that planning permission be granted subject to;

 

(a) completion of a s106 legal agreement;

(b) a condition requiring the submission of a travel plan to address travel movement generated by the development;

(c) and additional condition requiring the trees, hedgerows and mixed scrub being retained and / or enhanced post development; and

(d) the conditions set out at the end of this report.
